Required piercing the corporate veil — providing economic analysis and testimony

With 51 attorneys, this full-service commercial law firm organizes its practice into two primary sections —transaction and trial. Within these areas, its attorneys leverage their diverse knowledge and experience in a wide array of industries and areas of law.
Eric Liebman, a partner at the firm, has used GHP Horwath’s services for more than a decade, and has worked closely with our Forensic & Litigation Consulting and Valuation & Corporate Finance group for the past eight years on more than a dozen cases. In one such case Eric worked with GHP Horwath Principal Mark Pedigo on a complex legal issue in state court. Explains Eric, “It involved piercing the corporate veil to get through the corporation to its shareholders — which is a very difficult standard to meet. Mark used a very detailed and complex analysis to persuade the court in that situation that piercing the corporate veil was appropriate, and developed detailed exhibits that were very helpful to the court and on which the court relied heavily in its opinion.”
On another case, Eric worked with GHP Horwath Principal Lisa Meer on a complex business valuation issue. By presenting a coherent analysis of different valuation methods, and their pros and cons, Lisa showed that the company had substantially more value than the other party was claiming it did, and the court agreed.

According to Eric, “Before an expert’s opinion can be given in court, the expert is qualified by the court. It is thus important that the court know whether the expert is a hired gun who will say whatever he or she is paid, or whether he or she is helping the court by advising it on the complex issues in the case. GHP Horwath certainly has the latter reputation.”
